Terms of Use

The agreement

These terms cover your use of the CouchClash app, its online features and this website ("CouchClash", "we", "us"). By using CouchClash you agree to them. Apple's Licensed Application End User License Agreement also applies to the app; where these terms and Apple's differ for the app, these terms add to Apple's rather than replace them.

Using CouchClash

We give you a personal, non-exclusive, non-transferable license to use CouchClash on Apple devices you own or control, for your own entertainment. Players join your game in the CouchClash app or in a web browser; you're responsible for who you invite onto your Wi-Fi and for how the game is used at your gathering.

Purchases

CouchClash is free to play with its built-in packs, and each install gets 3 AI-written packs free. You can buy more AI packs individually or in a bundle. Purchased packs are credits for writing new packs: they don't expire, but they can't be transferred, exchanged for cash or moved to another Apple ID.

All payments go through Apple. Prices are shown in the App Store before you buy and may vary by region. Refund requests are handled by Apple at reportaproblem.apple.com.

CouchClash+ subscription

• CouchClash+ is a monthly auto-renewing subscription. Payment is charged to your Apple ID when you confirm the purchase.
• It renews automatically unless you turn off auto-renew at least 24 hours before the end of the current period. Your account is charged for renewal within 24 hours before the period ends.
• Manage or cancel it in Settings › your name › Subscriptions. Cancelling stops future renewals; you keep CouchClash+ until the period you paid for ends.
• "Unlimited" AI packs are subject to fair use: currently up to 25 new packs per day, to keep the service fast and affordable for everyone.
• CouchClash+ includes unlimited AI packs, the Jackpot and Mirror power-ups, bonus avatars and the choice of game length. We may add features; if we remove a core feature we'll tell you in the app first.

AI-written questions

AI packs are written by an AI model and checked by a second one, but AI can still make mistakes. Questions are for entertainment, not a source of fact or advice. If you spot a wrong answer, report it in the app (shake your phone) and we'll look into it.

You're responsible for the topics you enter. Don't use CouchClash to create content that is unlawful, hateful, harassing, sexually explicit, or that infringes someone else's rights, and don't include personal information about real people in a topic. We may refuse or remove topics and packs that break these rules. You may use packs you write for your own games; we may keep them to provide the service as described in our Privacy Policy.

Fair play

Please don't interfere with CouchClash or other people's use of it. That includes trying to get around purchases or limits, reverse engineering or modifying the app (beyond what the law allows), automating requests to our servers, or using the service to send spam or malware. We may suspend online features for installs that do.

Ownership

CouchClash, its design, artwork, built-in packs, name and logo belong to us. Apple's trademarks belong to Apple. Topics and other trademarks mentioned in questions belong to their owners and appear for trivia purposes only.

Changes and availability

We're always improving CouchClash, so features may change, and online features need our servers and our providers to be up. We'll try to give notice before major changes. We may update these terms; the date at the top shows the latest version, and using CouchClash after an update means you accept it.

No warranty

CouchClash is provided "as is" and "as available". To the extent the law allows, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose and non-infringement. Nothing in these terms limits rights you have under consumer law that can't be limited.

Limitation of liability

To the extent the law allows, we aren't liable for indirect, incidental, special or consequential damages, or for lost data or profits, arising from your use of CouchClash. Our total liability for any claim is limited to the amount you paid us for CouchClash in the 12 months before the claim.

Ending

You can stop using CouchClash anytime by deleting the app and cancelling any subscription. We may suspend or end access to online features if you break these terms. Sections that by their nature should survive (ownership, disclaimers, liability, governing law) do.

Governing law

These terms are governed by the laws of the State of California, United States, without regard to conflict-of-law rules, except where your local consumer law says otherwise.
